Will a lawsuit seeking damages for defamation actually resolve the underlying legal questions in the matter of Hayman Capital vs UDF?

On Tuesday, a Dallas County, Texas judge ruled that the lawsuit by United Development Funding (UDF) against hedge fund manager J. Kyle Bass and Hayman Capital, claiming false statements damaged their business, can proceed. The November 2017 suit contends that Bass knowingly misled key UDF business partners, journalists and the public at large so as to destroy the company, profiting to the tune of $60 million. While the charges of slander may seem like a sidebar in a legal case that has involving the FBI raiding UDF’s headquarters and a rigorous SEC investigation -- these cases remain open...
